These Terms and Conditions ("Agreement") set out the terms upon which City Connect Couriers ("we", "us", or "our") provides courier and transportation services to clients ("you", "your", or "the Customer"). By using our services, you agree to these terms.
**Definitions**
Client/Customer: The individual or business engaging City Connect Couriers for transportation services.
Carrier: City Connect Couriers or its authorised subcontractors responsible for providing the service.
Consignment: The goods or cargo to be delivered under the terms of the Agreement.
RHA Conditions: The Road Haulage Association Conditions of Carriage (2020 edition), which govern our services.
Proof of Delivery (POD): Evidence that the consignment has been delivered, including signatures or electronic confirmation.
Working Day: Any day other than a Saturday, Sunday, or UK public holiday.
**1. Governing Terms**
1.1 All services are provided under the latest edition of the Road Haulage Association (RHA) Conditions of Carriage, which are incorporated into this Agreement by reference.
1.2 Where any conflict arises between these terms and the RHA Conditions, the RHA Conditions shall prevail unless expressly agreed otherwise in writing.
**2. Service Scope**
2.1 We provide same-day courier services with dedicated vehicle transport across the UK.
2.2 We do not provide postal, parcel drop-off, or general freight forwarding services unless specifically agreed in writing.
2.3 We reserve the right to refuse service for items outside our standard transport offering, including prohibited, illegal, or hazardous items unless agreed.
**3. Quotations and Contract Formation**
3.1 All quotations are valid for 7 calendar days.
3.2 A contract is formed once a quotation is accepted verbally, electronically, or in writing, and service is confirmed.
**4. Customer Obligations**
4.1 The Customer is responsible for ensuring all details about the consignment are accurate and complete.
4.2 The Customer shall ensure the goods are correctly packaged and labelled for safe transport.
4.3 We reserve the right to reject improperly packaged, labelled, or undisclosed hazardous goods.
**5. Delivery and Proof**
5.1 Deliveries are completed to the address provided by the Customer unless otherwise agreed.
5.2 POD will be obtained at delivery, which may be a signature, photo, or other agreed form.
5.3 If access is restricted or delivery is refused, additional charges may apply.
**6. Loading and Unloading**
6.1 Customers are responsible for loading at collection and unloading at delivery.
6.2 Any loading/unloading assistance must be arranged in advance and may incur extra fees.
6.3 Unsafe or inaccessible loading/unloading areas may result in delay, cancellation, or surcharges.
6.4 Improper loading that results in damage or delay will be the responsibility of the Customer.
**7. Subcontracting**
7.1 We may subcontract any part of the service to approved third parties.
7.2 Subcontractors shall operate under equivalent conditions and standards.
**8. Charges and Payment**
8.1 Payment is due within 30 days of invoice unless otherwise agreed.
8.2 Interest and fees may apply for late payment under the Late Payment of Commercial Debts (Interest) Act 1998.
8.3 Non-payment may result in service suspension or legal recovery.
**9. Cancellations and Delays**
9.1 Cancellations must be received at least 2 hours before the scheduled collection.
9.2 Delays caused by traffic, weather, or force majeure events are not the Carrier’s liability.
**10. Liability and Insurance**
10.1 Liability is limited as per the RHA Conditions unless otherwise agreed in writing.
10.2 Claims must be submitted in writing within 7 days of the incident.
10.3 Exclusion of Indirect or Consequential Losses
We shall not be liable for any indirect or consequential loss, including (but not limited to) loss of profits, loss of business, loss of goodwill, or loss of anticipated savings, howsoever caused. Our liability is strictly limited to the physical loss or damage of goods as outlined under the RHA Conditions of Carriage (2020 edition), unless otherwise agreed in writing.
**11. Lien and Storage**
11.1 We reserve a lien over any goods for unpaid charges.
11.2 After 14 days, unclaimed goods may be sold or disposed of to recover fees.
**12. Law and Jurisdiction**
12.1 These Terms are governed by English law.
12.2 Disputes shall be subject to the exclusive jurisdiction of the English courts.
